Terms and Conditions

Please see below the Terms & Conditions between customers and Luxe Lend. The terms and conditions of Luxe Lend's service agreement with customers is outlined and it applies to the online rental of products. By signing up and/or purchasing services, you acknowledge that you have read, understood and accept these Terms and Conditions. 

1. DEFINITIONS AND INTERPRETATION

1. The following definitions shall apply to these terms and conditions:

a) Luxe Lend means Luxe Lend; a company registered in Ireland. The contract will be governed by and interpreted in accordance with The Laws of the Republic of Ireland. References to “us” or “we” shall be references to Luxe Lend. References to “you” is the person hiring from us.
b) Rental Period means the rental period as stated and requested in the rental order made through our site and shall begin on the date specified in the reservation of the product(s) and end on the date the product(s) are safely returned and received by Luxe Lend. For the avoidance of doubt, in the event that products are not returned to us on a day prior to or on the Return Date, the Rental Period shall be extended and shall only cease once the product(s) are safely returned and received by Luxe Lend.
c) Services means the luxury handbag rental service provided by Luxe Lend through this site.

2. Unless the context otherwise requires, references to ‘terms’, ‘conditions’, ‘terms and conditions’ or ‘these terms’ shall mean these terms and conditions.

3. Unless the context otherwise requires, references to Services (as defined above) shall be to the luxury handbag rental services offered by Luxe Lend and, for the avoidance of any doubt, shall not include any services rendered or offered by any third party.

4. Clause and paragraph headings shall not affect the interpretation of these terms.

5. Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms

2. Hire Agreement and Our Charges

  2.1 The booking will not be complete until payment and ID Verification is completed after the handbag is selected online. 

a) Charges for hiring goods
You must pay the hire charges as shown in the order. Hire charges will start at the day booked by you on the website and will continue until you have returned the goods to us in a clean and undamaged condition. Hire charges are due for the duration of  the time which you have the goods including Saturdays, Sundays and public holidays. You must pay all charges you owe when we ask them.

b) Late fees

The rental period of products acquired from the Luxe Lend is five days or a month (28 days) from the date outlined in the booking. If the rented product is not returned within the chosen rental period plus one grace day period there will be a late penalty fee of fifty euro (€30) per day that will be charged to the payment card or other payment methods provided and stored in your customer account, and you agree to pay such late fees, up to an amount not to exceed 100% of the Retail Value.  If you have not returned a product within twenty one (28) days after the return date, your late return will be considered a non-return and Luxe Lend will charge your payment card the maximum late fee (100% of the product retail value when new) less any late fees that you have already paid. 

3. Delivery and Collection

 You must pay us any agreed charges for delivering or collecting goods.  

4. When the Contract Starts

The contract comes into effect when you have placed an order and agreed to these conditions and we have accepted your offer.

5. Cancellations

Cancellations made 48 hours prior to the delivery day will not be refunded.

6. Your Responsibility when Hiring Goods

You assume responsibility for the goods once they are delivered to you. This includes protecting the items from weather, theft, vandalism, or improper use. Your responsibility continues until the goods are returned, unless you’ve made prior arrangements with us for collection.

You are required to return the goods at the end of the hire period unless alternative collection arrangements have been agreed upon. You must not sell, lease, or transfer control of the goods in any way. Third-party leasing or selling is strictly prohibited under our Terms & Conditions.

7. Maintaining Hired Goods

We kindly ask that you treat our items with the same care and attention as you would your own. We understand that normal wear and tear may occur, which includes small removable stains, minor scratches, and slight leather creasing. These will be covered by us at no additional cost to you.

If the item is returned with damage beyond normal wear and tear, you agree that we may charge you for the cost of repair or replacement. We respectfully request that customers refrain from attempting to clean or repair the items themselves.

You are responsible for ensuring that the items remain safe, clean, and in good condition. If any damage occurs, please report it to us immediately. You must return the item for inspection unless we have agreed on an alternative solution.

In the event that the item is involved in an accident causing damage, you must notify us immediately. You are also responsible for taking all necessary precautions to keep the items safe and protect them from theft or further damage.

8. Return Policy

If an item is lost, stolen, or not returned to Luxe Lend, we reserve the right to apply charges as outlined in the late fees section. In certain cases, we may take legal action for items that are not returned.

Luxe Lend will provide a pre-paid return label along with instructions for returning the borrowed item. You are responsible for returning the item in its original packaging, including the dust bag.

Upon returning the item, you will receive a reference number. Please retain this number in the unlikely event that the item is lost during the return process.

Luxe Lend is not responsible for any personal items left inside the handbags. If you believe you’ve accidentally sent us personal items, please contact us immediately.

9. Limits of our Liability

a) All the times we quote for delivering the goods are approximate

b) We will not be liable for any delays caused by circumstances beyond our reasonable control. 

10. Responsibility for Lost, Stolen, Damaged or Unclean Hired Goods

You are responsible for covering the cost of replacing any hired goods that are lost, stolen, or damaged beyond economic repair (i.e., when the cost of repair exceeds the value of the item). It is your responsibility to care for the goods and ensure they are returned to us in good condition.

Normal wear and tear, including small removable stains, minor scratches, and light leather creasing, will be covered by us at no cost to you.

However, if an item is returned with damage beyond normal wear and tear, you agree to cover the cost of repair or replacement. Additionally, if the goods are returned damaged or unclean, you must pay for the reasonable costs of cleaning or repairing the items.

11. Limits

Purchasing of services from Luxe Lend is based on our discretion. We reserve the right to place limits on rentals and the number of products purchased by one person. 

12. Communication

In registering and operating an account or signing up to our mailing list, you agree that ancillary to the services we may send you communications (by telephone, email, SMS text message, through our site or otherwise) as part of the day-to-day operation of the business. You may opt-out of receiving communications at any time. If you decide to opt-out of receiving communications, we retain our rights to contact you as may be required in the event of any dispute.

13. Separate terms

If any term in this contract cannot be enforced, this will not affect the remaining terms.
